Mediation is defined by Black’s Law Dictionary as the “private, informal dispute resolution process in which a neutral third person, the mediator, helps disputing parties reach an agreement. The mediator has no power to impose a decision on the parties” A mediation agreement, if reached, forms a binding contract, and may also be filed in a court of law and become an enforceable court order, signed by a judge.

Before Mediation
- Discuss your situation and your goals with your attorney (if you have representation)
- Gather your documents and other materials that may assist the mediation process
- Arrange to have other people with you if needed to resolve the situation
- List your goals, strengths and weakness of your situation, as well as those of the other party
- Consider what has kept you from settling to this point
The mediator
- Will control the discussion process, protecting the rights of each party to be heard
- Will assist each party in presenting their case so that all will understand the exact issues that require resolution
- Will assist the parties in discussing the strengths and weaknesses of their case
- Will advise the parties about the risks, the costs, and time required to go to court
why not just go to court?
- Process may take two years or more depending upon case complexity, schedules of parties, experts, courts, witnesses and attorneys
- Appeal process may add another year – a successful appeal places the matter back to the trial court, to begin anew, and may repeat
- Attorneys, expert and lay witnesses will most likely be required to present the case
- All costs, legal fees and expert witnesses, are borne by each party – courts rarely award the prevailing party
- Obtaining a judgment rarely means the issue is over, collections and other issues may go on for years.
- Retain control of your own outcome, rather than having others dictate the results
